Terms of Service

These terms govern your use of ServeX Guard Cloud, the hosted service at servexguard.com and dashboard.servexguard.com (the "Service"), operated by El Mahdi El Aimani, an individual trading as ServeX Guard, Rabat, Morocco ("we", "us"). By creating an account you agree to them. If you do not agree, do not use the Service.

1. What the Service does

ServeX Guard is a quality gate for retrieval-augmented generation (RAG) and LLM systems. It has two parts, and the split matters for these terms:

• The CLI: open source under Apache 2.0, downloaded and run on your own machines and CI runners. It performs all evaluation locally. Its licence, not these terms, governs your use of it.
• The Cloud: this Service. It receives results the CLI or SDK has already computed, stores them, displays them, computes a nightly drift score from stored vectors, and sends alerts.

The Cloud performs no evaluation of your content. It receives JSON that your own infrastructure produced.

2. Accounts

• You must provide a valid email address and keep your credentials confidential.
• You are responsible for all activity under your account and under any API key issued to it.
• API keys are shown once at creation and stored by us only as a SHA-256 hash. We cannot recover a lost key; rotate or revoke it from the dashboard.
• You must be at least 18 years old, or the age of majority where you live.
• Accounts are for a single organisation. Do not share credentials outside it.

3. Plans, trials and billing

• The Pro trial lasts 30 days. Cancel before it ends and you are charged nothing.
• Subscriptions renew automatically each month until cancelled.
• Prices are in US dollars and exclude tax unless stated at checkout.
• We may change prices with at least 30 days' notice by email. The change takes effect at your next renewal; you may cancel before it applies.
• Refunds are governed by our Refund Policy.

4. Cancellation and termination

• You may cancel at any time. Your plan stays active until the end of the paid period, then reverts to Free.
• On reverting to Free, the Free retention window applies and older data becomes inaccessible, then is deleted by our scheduled purge.
• You may delete your account by contacting mahdielaimani@gmail.com. Deletion removes your projects, runs, samples and keys.
• We may suspend or terminate an account that breaches section 5, does not pay, or puts the Service or other customers at risk. Where circumstances allow, we give notice first.

5. Acceptable use

You must not:

• Attempt to access another customer's data, or probe, scan or test the Service's security without our written permission;
• Exceed the published rate limits by distributing traffic across keys or accounts, or otherwise degrade the Service for others;
• Upload content you have no right to send us, including personal data you are not permitted to process (see the Privacy Notice);
• Resell, sublicense or white-label the Cloud without a written agreement;
• Use the Service to build a substantially similar competing hosted product.

6. Your data

You keep all rights in the data you send us. You grant us only the licence needed to run the Service: to store your data, display it back to you, compute drift scores from it, and send you alerts about it.

We do not sell your data, and we do not use it to train models.

By default the monitoring SDK sends us a vector representation of your production traffic and not the underlying text. Storing text is opt-in. Details are in the Privacy Notice.

7. Availability

We aim for high availability but the Free and Pro plans carry no service level agreement. The Service depends on third parties (hosting, database, embedding and email providers) and may be interrupted by their outages or by maintenance. An SLA is available only under an Enterprise agreement.

Alerting is best effort. Email delivery can be delayed or blocked by your mail provider, and an embedding-provider outage can leave a gap in drift scoring. Do not rely on this Service as your only safeguard against a production failure.

8. No warranty

The Service is provided "as is". To the fullest extent permitted by law we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement.

ServeX Guard reports quality signals; it does not certify that an AI system is safe, accurate, compliant or fit for any purpose. Decisions you take on the basis of its output remain yours.

9. Limitation of liability

To the fullest extent permitted by law, neither party is liable for indirect, incidental, special or consequential damages, or for lost profits, revenue, goodwill or data.

Our total aggregate liability arising out of or relating to the Service is limited to the amounts you paid us in the 12 months before the event giving rise to the claim.

Nothing here excludes liability that cannot be excluded by law, including for fraud or for death or personal injury caused by negligence. If you are a consumer, your statutory rights are unaffected.

10. Confidentiality

Each party will protect the other's non-public information with at least reasonable care and use it only to perform under these terms.

11. Changes to these terms

We may update these terms. For material changes we will give notice by email or in the dashboard at least 30 days in advance. Continuing to use the Service after the change takes effect means you accept the updated terms.

12. Governing law

These terms are governed by the laws of the Kingdom of Morocco, and the competent courts of Morocco have exclusive jurisdiction, without prejudice to any mandatory consumer protections in your country of residence.
